1. Preamble

These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between www.harea-de-madagascar.com (hereinafter referred to as “the Seller”) and any individual or legal entity (hereinafter referred to as “the Customer”) wishing to make a purchase from the www.harea-de-madagascar.com website (hereinafter referred to as “the Site”). By placing an order on the Site, the Customer unreservedly accepts these GCS.

2. Object

The purpose of these GCS is to define the rights and obligations of the parties in connection with the online sale of products offered by the Vendor to the Customer.

3. Products

The products offered for sale are those listed on the Site on the day of consultation by the Customer. Each product is accompanied by a description drawn up by the Seller. The photographs of the products are as accurate as possible, but cannot guarantee a perfect similarity with the product offered.

4. Awards

Product prices are quoted in euros, inclusive of all taxes, and exclude shipping and handling costs. The Vendor reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the Customer.

5. Control

The Customer may place an order on the Site by following the appropriate process. The order will only be definitively validated once the Customer has received confirmation of the order by e-mail. The Vendor reserves the right to refuse any order for legitimate reasons, in particular in the event of non-payment or incorrect address.

6. Payment

Payment is made online by credit card or any other means offered on the Site. Transactions are secured by a certified payment service provider. The card is debited when the order is validated.

7. Delivery

Products are delivered to the address indicated by the Customer at the time of ordering. The Vendor undertakes to dispatch products within the times indicated on the Site. In the event of late delivery, the Customer will be informed by email. The Seller cannot be held responsible for delays in delivery attributable to the carrier.

8. Right of withdrawal

In accordance with current legislation, the customer has a period of 14 days from receipt of the products to exercise his right of withdrawal without having to justify his decision or pay any penalties. Products must be returned in their original condition and complete. Return shipping costs are at the Customer’s expense.

9. Warranty and liability

Products are covered by the legal guarantee of conformity and the guarantee against hidden defects. In the event of non-conformity or defect, the Customer must notify the Seller as soon as possible. The Vendor may not be held liable in the event of misuse of the products by the Customer.

10. Protection of personal data

The information collected by the Vendor at the time of the order is necessary to manage the order and improve the services offered. The Vendor undertakes to respect the confidentiality of the personal data communicated by the Customer and to process them in compliance with the regulations in force.

11. Intellectual property

All elements of the Site are and remain the exclusive intellectual property of the Seller. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the Site, whether software, visual or sound.

12. Applicable law and jurisdiction

These terms and conditions are governed by Malagasy law. In the event of a dispute, the parties agree to seek an amicable solution before taking any legal action. Failing amicable resolution, the courts of Madagascar shall have sole jurisdiction over any dispute.
